To answer frequently asked questions about personal and family law, particularly divorce in Switzerland, we have prepared this concise FAQ.

In Switzerland, there are two main types of divorce proceedings.

Divorce on unilateral application Divorce: Only one of the spouses wishes to divorce. This request can be made after a separation of two years or immediately if there are serious grounds that make the continuation of the marriage unbearable, such as domestic violence.

Divorce by joint petition The two spouses agree to divorce. This procedure can be with full agreement (the spouses agree on all the effects of the divorce) or with partial agreement (the spouses agree on the principle of the divorce but not on all its effects).

The consequences of a divorce on the right of residence in Switzerland depend on the type of residence permit held.

B permit obtained through family reunification : The right to remain in Switzerland after divorce is subject to certain conditions, such as the duration of the marriage, integration in Switzerland or major personal reasons.

C licence : Holders can generally remain in Switzerland after the divorce.

In a divorce, the court decides on the allocation of parental authority, custody of the children and visiting rights. Decisions are based on the welfare of the child. Maintenance obligations (alimony) are also set to ensure the financial support of minor children, and sometimes adult children, as well as, in some cases, the ex-spouse.
