Road traffic: the same rules for everyone?
Road traffic: the same rules for everyone?
"I often cycle and I wanted to know to what extent the highway code also applies to bicycles. Do I have to follow the same road signs? And can I ride on the pavement?"
Andrea, Geneva
Under article 1 paragraph 2 of the law on road traffic (LCR), drivers of motor vehicles and cyclists are subject to traffic regulations on all roads used by the public.
Cyclists must comply with the same road traffic regulations as car drivers. They must obey the same traffic signals and pay the same attention to traffic. In fact, article 26 LCR states that everyone must behave in traffic in such a way as not to hinder or endanger those using the road in accordance with the established rules. Cyclists must therefore behave with the consideration due to other road users.
In particular, according to article 49 LCR, pavements are intended for pedestrians. Cyclists should therefore not use them to circulate.
It should be noted that special rules apply to cyclists, such as the requirement to wear a sticker in place of a distinctive sign and providing proof that third-party liability insurance is in place (article 34 of the Ordinance on vehicle insurance). In addition, children under the compulsory school age are not allowed to drive a cycle (article 19 LCR). Cyclists whose skills raise doubts may be tested (article 19 paragraph 4 LCR). For example, a cyclist's blood alcohol level may be checked, on the understanding that riding drunk on the road represents a danger to other road users.
Finally, you should know that the canton of residence can ban from driving a cycle any person who has seriously or repeatedly endangered traffic, or who has been drinking and driving. The ban will be for at least one month (article 19 paragraph 3 LCR).
